Exclusions and Prohibited Conduct

You must not misuse this Website. You will not: commit or encourage a criminal offence whether by yourself or a third party; transmit or distribute a virus, Trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as “spam”; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offence.  ArmsDealer will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. All prices are in Australian dollars and are inclusive of Goods and Services Tax (G.S.T) unless expressly stated otherwise.
Although every reasonable effort is made to dispatch your order in a timely fashion, dispatch times may vary according to availability of stock and any guarantees or representations made as to delivery times are subject to delays resulting from postal delays or force majeure for which we are not responsible.

You must be over the age of 18 and possess a valid credit card issued by a bank acceptable to us.  For some items known as restricted items, ArmsDealer will request proof of your authority to posses such items.  Failure to provide adequate proof will void any arrangement between buyer and seller.  ArmsDealer reserves the right to refuse any request made by you, terminate accounts, remove content or cancel orders at its own discretion.  If your order is accepted we will inform you by email and we will pursue every reasonable effort to confirm your identity and your authority to posses.  Where required of us to do so by law, we may disclose your personal information and/or your proof of authority to possess a restricted good or firearm to the relevant Government regulatory authority(s).  This will usually be by ArmsDealer or may in some cases be a third party. 

Where a contract is made with a third party ArmsDealer is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you.  When placing an order you undertake that all details you provide to us are true and correct, that you are an authorized user of the credit card used to place your order and that there are sufficient funds to cover the cost of the goods.  The cost of foreign products and services may fluctuate. All advertised prices are subject to change. 

Correction of Errors

ArmsDealer makes every reasonable effort to display accurate information on the web site, the information may contain typographical errors or inaccuracies and may not be complete or current.  We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order and/or made payment). Such errors, inaccuracies or omissions may relate to product description, pricing and availability.  If, for example, the price or description of a product offered for sale on the web site is incorrect due to a technical or administrative error, any agreement arising from any acceptance of such offer will, at ArmsDealer’s discretion, be void. 

Limitations on Quantity

We reserve the right to limit quantities (including after you have submitted your order and/or made payment).  We welcome you to Contact US to inform of any errors or omissions that you perceive to be pertinent.  We apologize for any inconvenience this may cause you.  If you are not fully satisfied with your purchase please see our returns policy for details on how to obtain a refund.

Terms of Delivery

By using this website and therefore accepting these terms you agree to appoint the carrier or postal agent to be your agent in delivering the products on your behalf. Disputes over non-delivery or lost parcels shall be directed to each respective carrier.  ArmsDealer or its carriers will not be liable or responsible in any way for your typographical errors in the delivery address and or return address.

Intellectual Property – Copyright/Trademark Information

ArmsDealer reserves exclusive right to this entire web site, including images, logos, text, and content.  The ArmsDealer trade mark and logo are the intellectual property of ArmsDealer. All other trade marks are the property of their respective owners, who are not associated with ArmsDealer in any way.  Permission to use documents delivered from the web site and/or server and related graphics is restricted.

The name of ArmsDealer or any of its trademarks or logos may not be used without Arms Dealer’s specific, written permission.  The information contained on the web site is subject to change without notice. Although every reasonable effort is made to ensure accuracy within this web site, we are not responsible for typographical, technical, or descriptive errors.

Indemnification

You agree to indemnify and hold ArmsDealer and its employees, representatives, agents, affiliates, directors, officers, managers and shareholders (the “Parties”) harmless from any damage, loss, or expense (including without limitation, reasonable legal costs and expenses on a full indemnity basis) incurred by you or by the Parties arising from any claim, demand, suit, action or proceeding by any person against you or the Parties where such loss or liability arises out of, in connection with or in respect of your use of the Web Site, any breach by you of these Terms and Conditions and/or any goods purchased by you from ArmsDealer.

Information You Submit to ArmsDealer

We welcome your comments regarding the ArmsDealer web site. However, any comments, feedback, notes, messages, ideas, suggestions or other communications (collectively known as, “Comments”) sent to ArmsDealer shall be and remain the exclusive property of ArmsDealer. Your submission of any such comments shall constitute a transfer to ArmsDealer of all rights, titles and interests in all copyrights and other intellectual property rights of the comments.  ArmsDealer will be entitled to use, reproduce, disclose, publish and distribute any material you submit for any purpose whatsoever, without restriction and without compensating you in any way. For this reason, we ask that you do not send us any comments that you do not wish to assign to us, including any confidential information or any original creative materials such as stories, product ideas, computer code or original artwork.  With relation to your personal privacy and identity, please consult our Privacy Policy.

Communication with ArmsDealer

We retain the right to email you product alerts and special offers that we consider may be of interest to you.  We respect your right not to receive these communications should you choose.  Our correspondences will contain a clear link to Unsubscribe.  Once you have unsubscribed we will remove your name from the communication list and will no longer send you these special offers and alerts, unless you choose to re-subscribe at a later date.

Trademarks

Trademarks owned by ArmsDealer are protected by law.  The use of such marks must not be done without the express permission of the trademark holder.  

Disclaimer

We encourage all our customers to start with thoroughly understanding and implementing the 10 Commandments of Firearms Safety.

Reloading ammunition can be potentially dangerous if carelessly executed.  We highly recommend that all reloaders purchase a current reloading manual and educate themselves as to the potential risks associated with reloading.  Shooting is a fun and exciting sport, but handling propellant powders, ammunition and firearms should always be done by competent well informed individuals. 

When reloading, always start with the minimum powder charge load for your chosen caliber and systematically increase the charge in strict compliance to the load data set out in the reloading manual.  Never exceed the charge weight specific to your powder and caliber set out in the manual.  Overloaded cartridges containing too much propellant powder can create excessive pressure and have the potential to explode. 

ArmsDealer will not be responsible for damages caused to person, property or otherwise by a negligent and ill-informed reloader.  Be safe, educate yourself and read a current reloading manual specific to the cartridge, bullet, primer and powder you are using. 

Other parties

You accept that, ArmsDealers’ parent company, as a limited liability entity, has an interest in limiting the personal liability of its officers and employees.  You agree that you will not bring any claim personally against ArmsDealer officers or employees in respect of any losses you suffer in connection with the website.

Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect ArmsDealer officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as ArmsDealer.  

Unenforceable provisions

If any provision of this website disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.

Governing Law

ArmsDealer.com.au and its firearm dealers are registered in the state of Queensland.  In accordance with this, ArmsDealer is bound by Queensland Legislation to the point where these acts are superseded by Commonwealth legislation.  In relation to weapons and explosives, ArmsDealer adhears to the Weapons Act 1990, Weapons Regulations 1996, Explosives Act 1999 and the Explosives Regulations 2003.
